Welcome to https://melindagaleria.com (the “Site”). These Terms & Conditions (“Terms”) set out the terms on which we sell products through the Site. By placing an order or using the Site you agree to these Terms. If you do not agree, please do not use the Site.

1. About us

Melinda Galeria is a sole trader registered and operating in the United Kingdom. We design original artwork which we sell on print-on-demand products (mugs, apparel, homewares, etc.). Products sold on the Site are printed and fulfilled by Printify and Printify’s network of printing partners.

2. Who we sell to

We currently accept orders for delivery to customers in the United States of America and Canada only. We may decline, suspend or cancel orders for delivery to addresses outside these territories. If an order is placed outside these territories in error, we will contact you to cancel the order and issue a refund.

3. How a contract is formed

When you place an order you will receive an order acknowledgement email confirming the details of your order. This acknowledgement does not constitute acceptance of the order. A contract between you and us is formed when we send a dispatch confirmation email confirming that the goods have been shipped. If we cannot accept your order (for example because the product is unavailable or because of a pricing error) we will contact you and refund any sums paid.

4. Prices, currency & payment

  • All prices on the Site are shown in US Dollars (USD) unless otherwise stated.
  • Prices displayed include any fees we are required to include; any applicable local import duties or taxes in the destination country are the responsibility of the recipient unless we explicitly state otherwise.
  • Payment is processed by our third-party payment providers (for example Stripe, PayPal or similar). We do not store full payment card numbers on our servers. By placing an order you authorise us to charge the card or payment method you provide.
  • If a pricing error occurs, we reserve the right to cancel the order and refund you.

5. Availability & fulfilment (Printify)

  • All products are produced and shipped by Printify and Printify’s network of printing partners. By placing an order you authorise us to share your name, shipping address and order details with Printify for the purpose of printing and shipping your order.
  • Production and shipping times shown on product pages are estimates provided by Printify and may vary. We will use reasonable endeavours to ensure accurate lead times but cannot guarantee exact shipping dates.
  • Because production and fulfilment are performed by third parties, there may be small variations in print placement, colour and sizing between items and between production runs. Such minor variations do not constitute a defect.

6. Shipping, import duties & taxes

  • Delivery estimates and shipping charges are set out in our Shipping, Returns & Refunds Policy (linkable from the footer).
  • Import duties, customs fees and taxes that apply in the destination country are normally the responsibility of the customer and are not included in the product price or shipping charge unless we expressly state otherwise. Please check local customs rules before ordering.

7. Cancellation, returns & refunds

  • Please see our Shipping, Returns & Refunds Policy for full details of cancellations, returns, refund eligibility and the procedure to follow.
  • Customised or personalised products are typically non-returnable unless faulty or incorrectly produced. We will clearly indicate where a product is personalised and therefore excluded from standard returns.

8. Product descriptions & images

  • We make every effort to describe our products accurately. However, display monitors and mobile devices can show colours differently and print variations may occur. Minor differences in colour, dimensions, or placement are not normally considered faults.
  • If an item is materially incorrect or faulty, please follow the returns procedure set out in our Shipping, Returns & Refunds Policy.

9. Intellectual property

  • All designs, artwork, text, graphics and images on the Site are the intellectual property of Melinda Galeria (unless otherwise stated). You may not copy, reproduce, republish, upload, post or transmit any of our content without our prior written permission.
  • If you believe your intellectual property rights have been infringed by content on our Site, contact us at the address above with full details so we can investigate.

10. User content (reviews, comments)

  • Any reviews, comments or other material you post on the Site may be published and remain visible publicly. By submitting content you grant us a non-exclusive, royalty-free, perpetual licence to use, reproduce, adapt and publish that content in connection with the Site and our business.
  • We reserve the right to remove or refuse to publish any content which we reasonably consider unlawful, abusive, libellous, offensive or otherwise objectionable.

11. Liability & disclaimers

  • To the fullest extent permitted by applicable law, our liability for any loss or damage arising out of or in connection with the supply of products is limited to the price paid for the relevant products.
  • Nothing in these Terms affects your statutory rights as a consumer that cannot be excluded or limited by law. Where you are a consumer outside the UK, you may have additional rights under your local consumer protection laws. If there is any conflict between these Terms and your jurisdiction’s mandatory consumer rights, those rights will apply.

12. Indemnity

You agree to indemnify and hold us harmless against any losses, liabilities, costs or expenses (including reasonable legal fees) arising from your breach of these Terms, your negligent or unlawful act, or your use of the Site in a manner not authorised by these Terms.

13. Data protection & privacy

Our use of personal data is governed by our Privacy & Cookie Policy. By placing an order or using the Site you agree that we may use your personal data in accordance with that policy. (Link: Privacy & Cookies)

14. Third-party services & links

The Site may contain links to third-party websites and services (including Printify and payment providers). We are not responsible for the content, privacy practices or terms of those third parties. Inclusion of links does not imply endorsement.

15. Changes to the Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page will show the date of the most recent update. Continued use of the Site after changes are published will constitute acceptance of the updated Terms.

16. Severability & entire agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or removed to the minimum extent necessary so these Terms remain otherwise in full force and effect. These Terms, together with any documents referred to in them, constitute the entire agreement between you and us relating to their subject matter.

17. Governing law & jurisdiction

These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of England and Wales. Subject to your statutory consumer rights, the courts of England and Wales will have exclusive jurisdiction to settle any disputes.

18. Contact & complaints

If you have any questions, complaints or requests relating to these Terms, orders or products, please contact us:

Email: [email protected]
Address: Lytchett House, 13 Freeland Park Wareham Road, Lytchett House, Poole, Dorset, England, BH16 6FA

We will try to resolve complaints quickly and fairly. If you remain dissatisfied you may have the right to refer the matter to a consumer protection authority in your country (for example the US state consumer protection agency or the Canadian provincial authority) or to the UK Information Commissioner’s Office (ICO) for data protection issues.

1. Introduction

Melinda Galeria (“we”, “us”, “our”) is committed to protecting and respecting your privacy.

This Privacy & Cookie Policy explains:

  • what personal data we collect,
  • why we collect it,
  • how we use it,
  • who we share it with,
and your rights under applicable privacy laws (including UK GDPR and, where relevant, US privacy rules such as CCPA).

We sell print-on-demand products to customers in the USA & Canada. Orders are fulfilled by Printify and Printify’s printing partners (primarily located in the USA). Because we’re a UK-based business, UK data protection law (UK GDPR & Data Protection Act 2018) applies to how we handle data.

We collect and process different types of personal data depending on how you use the site and place orders:

When you place an order

  • Full name
  • Delivery address
  • Email address
  • Phone number
  • Order details and purchase history

When you pay

  • Payment card details are collected by the payment provider (e.g., Stripe, PayPal). We do not store full card numbers on our servers. We may receive transactional payment metadata (transaction ID, amount, billing name).

When you contact us / sign up

  • Email address, name and any information you send in messages or newsletter signups.

Technical & usage data

  • IP address, browser type and version, operating system, referring URLs, device identifiers, pages visited, and other analytics data.

  • If you leave a comment or review we collect the information shown in the comment form, plus the IP address and browser user-agent string to help spam detection.

3. How we use your personal data (purposes & legal bases)

We use your data for the following purposes:

  • To fulfil orders and provide products (contractual necessity): share name, address, phone and order details with Printify and their print partners so they can print and ship your order.
  • To process payments (contractual/legitimate interest): forward payment data to our payment provider for authorisation and settlement.
  • To communicate about orders & customer service (contractual/legitimate interest): send order confirmations, shipping updates, and respond to enquiries.
  • To send marketing emails (consent, where given): if you opt in to newsletters/promotions, we will email you. You can unsubscribe at any time.
  • To improve the site and for analytics (legitimate interest): using analytics tools to understand site performance and user behaviour.
  • To comply with legal obligations (legal obligation): e.g., tax/record keeping, fraud prevention, responding to lawful requests.
  • To detect and prevent fraud or abuse (legitimate interest).

4. Who we share your data with

We share personal data only as necessary to provide services:

  • Printify and Printify’s print partners — to fulfil orders (shipping, printing). These partners may be located in the United States; international transfers are described below.
  • Payment processors (e.g., Stripe, PayPal) — to take and process payments.
  • Email and marketing providers (e.g., Mailchimp or similar) — if you subscribe to our newsletter.
  • Analytics providers (e.g., Google Analytics) and advertising platforms (if you enable marketing cookies).
  • Service providers we use for business operations (fraud detection, hosting, email delivery, customer support).
  • Legal or regulatory authorities — if required by law or to protect our legal rights.

We do not sell your personal data for third-party marketing purposes.

5. International transfers

Some service providers we rely on (e.g., Printify, payment processors, cloud hosts) operate in countries outside the UK, including the United States. When we transfer personal data outside the UK we put appropriate safeguards in place (such as standard contractual clauses or relying on an adequacy decision where available) to ensure your data is protected.

6. Cookies & similar technologies

We use cookies and similar technologies to operate the site and improve your experience.

  • Preferences cookies – remember choices you make (e.g., language, display preferences).

  • Login/session cookies may be set when you log into the site.

Managing cookies

  • You will be shown a cookie banner on your first visit asking for consent for non-essential cookies. You can change your choices at any time by clicking the cookie settings link in the footer [or via your browser settings].
  • To completely block cookies, you can change your browser settings to refuse cookies — refer to your browser help pages for instructions.

7. Data retention

We retain personal data only for as long as necessary:

  • Withdraw consent – where processing is based on consent, you may withdraw consent at any time.

To exercise any of these rights, contact us at: [email protected]
We will respond within the timeframes required by law.

If you are in California, you may also have additional rights under the California Consumer Privacy Act (CCPA/CPRA) — for example, rights to know categories of data collected and with whom it is shared, and to request deletion or opt out of sale. We do not “sell” personal data for third-party marketing, but if you believe otherwise please contact us and we’ll respond to your request.

You also have the right to lodge a complaint with a supervisory authority. In the UK, that is the Information Commissioner’s Office (ICO): https://ico.org.uk/

9. Security

We take reasonable steps to protect personal data from loss, misuse and unauthorised access, but no system is completely secure. Access to personal data is limited to staff and service providers who need it to perform their functions.

10. Children

Our website and services are not directed at children under 13 (or the minimum age in your jurisdiction). We do not knowingly collect personal data from children. If you believe we have inadvertently collected data from a child, contact us to request deletion.

11. Embedded content & third-party sites

Pages on this site may include embedded content (e.g., videos, social media, maps). Embedded content behaves as if you visited the third-party site directly — those services may collect data about you, use cookies, and track interactions. This policy does not cover how third parties use your data; please review their privacy policies.

12. Changes to this policy

We may update this Privacy & Cookie Policy from time to time. The “Last updated” date at the top shows the most recent revision. Significant changes will be notified on the site or by email where appropriate.
